The Pressure Pipe Inspection Company files suit seeking Declaratory Judgment to invalidate Pure Technologies' patents
For Immediate Delivery
Mississauga, Ontario, Canada - February 21, 2005 - The Pressure Pipe Inspection Company Ltd (PPIC Ltd.) and Pressure Pipe Inspection Company (USA) Inc. (PPIC USA) announced today that they have filed suit in federal court in Dallas, Texas against Pure Technologies, Ltd. (Pure Technologies), seeking a declaratory judgment that Pure Technologies' U.S. Patents Nos. 3,781,369 and 3,791,318 for "Electromagnetic Analysis of Concrete Tensioning Wires" are invalid and unenforceable.
The suit alleges that the equipment used by PPIC Ltd. and PPIC USA was partially developed, tested, and commercialized in Texas long before patent applications for the two patents were ever filed by Pure Technologies.
The declaratory judgment also asks the court to rule that the equipment used by PPIC Ltd. and PPIC USA does not infringe on Pure Technologies' patents. Pure Technologies Ltd., had previously sued PPIC Ltd. and PPIC USA in Philadelphia for infringement of its two patents. On February 17, PPIC Ltd. and PPIC USA filed a motion to dismiss the complaint for lack of jurisdiction and improper venue.
